A federal jury is expected to hear arguments Monday regarding the meaning of the Affordable Care Act’s coverage of erectile dysfunction drugs, including Viagra and the two-year-old erectile dysfunction lawsuit.
Judge Richard W. Jiankain Jr. announced the verdict after a jury in Louisiana ordered a second-degree misdemeanor charge of criminal conspiracy to cheat on a person and his spouse.
Judge Jiankain ruled there was enough evidence to warrant a new trial.
He found the defendants to be presumed innocent of the charge of misdemeanor charges, a second-degree felony, and a felony count of conspiring to cheat on a person and his spouse.
The trial began Monday, where the jury heard testimony from the plaintiffs’ lawyers who claimed that the defendants conspired to cheat on them by making threats and promises of financial compensation.
In a separate statement, the plaintiffs’ attorney, Richard A. Brown, said the jury was not warranted and that “a finding of guilt on the evidence presented will be upheld.”
The plaintiffs’ attorney said that the verdict means that the jury will not be told how the defendants committed their crimes.
The case is expected to be heard in court Tuesday.
The federal judge dismissed the defendants’ case in the same day, the jury returned a verdict against them and ordered a new trial.

Under federal law, a federal judge may extend a new trial for three months after a defendant’s convictions and conviction-free periods after a second-degree felony conviction. But the judge has limited the time allowed for a new trial to two months after a first-degree felony conviction.
“The court considers the defendant’s case very difficult,” said Susan A. Koeppel, a lawyer for the plaintiffs’ attorney, who represented the defendants.
“The court’s instructions on the motion to extend the time for a new trial are a strong measure to assure that the defendants will receive a fair and effective defense.”
The defendants are expected to be heard Monday morning.

U. S. District Judge Jian H. Johnson issued a ruling Wednesday afternoon in this case.
“This is a complex case that will be determined by the jury,” said U. Attorney Jillian C. Johnson. “The government, however, will not be able to make a claim of guilt on the evidence presented.”
